ASIC highlighted that the Federal Court of Australia has declared numerous terms that are there within six small business agreements used by Bendigo and Adelaide Bank as unfair.
The relevant agreements are basic form ‘small business’ loan deals which the bank signed with its clients after 12 November 2016.
Now, Bendigo and Adelaide Bank has to give an undertaking to the Court not to use, or depend on, any of the impugned conditions in a way that is unethical or causes any customers to suffer loss or damage.
