Martin Shkreli has been ordered by a New York federal judge to surrender all digital copies of a rare Wu-Tang Clan album, as legal proceedings continue. This development follows Shkreli's earlier forfeiture of the physical album in 2018.
The album, a unique piece of Wu-Tang Clan's discography recorded between 2007 and 2013, was seized from Shkreli after his 2018 conviction for securities fraud. In 2021, it was acquired by Please DAO, a decentralized autonomous organization which purchased the album from the Justice Department for $4.75 million.
Please (DAO), which now holds the physical album, has been selling fractional ownership through non-fungible tokens (NFTs). The organization alleges that Shkreli retained digital copies of the album and has been distributing or playing them, causing “significant monetary and irreparable harm” to PleasrDAO. Consequently, PleaseD filed a lawsuit against Shkreli in June 2024.
On August 26, the federal judge's ruling required Shkreli to turn over all forms of digital copies of the album to his lawyers by August 30. Additionally, Shkreli must file an inventory by September 30 detailing the copies, including information on individuals with whom the album was shared and any financial benefits he gained from its distribution.
This order follows Please DAO's request for a preliminary injunction, which was filed on August 19. Pleasure's lawsuit claims that Shkreli’s actions have undermined the exclusivity of the album’s ownership and seeks a court order to permanently seize the alleged digital copies and prevent any further financial exploitation of the album.
Shkreli’s legal representative, Edward Paltzik of Bochner PLLC, stated that the court’s order is a preliminary measure and does not determine the final outcome of the case. The court has not yet assessed the validity of Please DAO's claims, and Shkreli’s motion to dismiss the case will proceed.
PleasrDAO has publicized the court’s order on social media, further asserting its stance on the matter while pursuing a resolution to its claims.
