The nanny tax is not a separate or special tax. It refers to the payroll tax responsibilities that arise when you hire someone to work in your home, such as a nanny, babysitter, housekeeper, or caregiver. In countries like the United States, if you pay a household worker above a certain annual threshold and control their work schedule and duties, you are legally considered their employer. This means you must handle employment taxes just like a business would. The main components include Social Security and Medicare taxes (FICA), which total about 15.3% of wages and are shared between employer and employee. Employers are also responsible for Federal Unemployment Tax (FUTA) if wages exceed a set quarterly limit, as well as state unemployment insurance and, in some cases, state income tax withholding. Failing to comply can result in penalties, interest, and back taxes. Misclassifying a nanny as an independent contractor to avoid payroll taxes is illegal and may lead to legal consequences. However, proper compliance also brings benefits. The employee earns Social Security and Medicare credits, building future benefits and maintaining a documented work history. Employers may qualify for tax relief options such as the Child and Dependent Care Credit or flexible spending arrangements to reduce overall costs. In simple terms, the nanny tax is the set of legal payroll obligations that apply when you formally employ a household worker.
