The Full Federal Court dismissed the appeal made by ACCC against TPG Internet Pty Ltd with respect to the marketing & sale of a few prepaid internet, home telephone and mobile plans.
As per the prepaid plans at issue, the customers are required to make a prepayment of minimum A$20 for the possible use of services not contained in the value of their plan. In case the prepayment balance goes below A$10, TPG topped up the prepayment balance to $20, automatically. In case the plan was cancelled, the prepayment balance was forfeited.
As per ACCC, TPG was misleading consumers by not sufficiently unveiling the particulars about the mandatory prepayment.
