Witness recounts Sydney man's garage death

The neighbour of a Sydney man run down by his ex-partner after she caught him with another woman has recounted in court the moment she saw him killed.

Jackline Sabana Bona Musa is accused of murdering Payman Thagipur on June 27, 2020, by deliberately driving her SUV into him with an intent to either kill or cause serious injury.

Mr Thagipur's neighbour Mehenaaz Ali was at home in Wentworth Point when banging sounds from the apartment complex's garage led her to investigate a stuck roller door, the NSW Supreme Court murder trial was told on Wednesday.

Ms Ali returned to her apartment to retrieve her phone after a car with two girls waiting outside asked for the building manager's number to fix the door where she encountered Musa asking to be let in.

She said the accused told her she lived in the apartment next door and that her "swipe (card) was not working".

After returning to the garage, Ms Ali said she saw Musa walking to the other end of the car park.

Mr Thagipur, who Ms Ali knew as Paul, arrived at the car park shortly after and they exchanged a few words about the broken roller door.

"I was standing by the garage door and I heard a loud rev of an engine as if something very fast or very loud was coming."

Ms Ali shook and was visibly distressed as she recounted the moment Mr Thagipur was hit by the black Toyota Kluger.

"He was still attached, dragged by the bull bar and then pinned to the wall."

Crown prosecutor Emma Blizard asked what she did next.

"I screamed and I ran. I went under the roller door, and I got into the car of the two girls. I just told them to drive."

When police arrived, Ms Ali said she showed them towards the car park. 

"I saw Paul. He was on the floor gasping for air and there was blood ... coming out of his body," she said.

Ms Ali recounted Musa had told her Mr Thagipur "came in front of the car".

Earlier that night, Musa caught Mr Thagipur in his underwear with another woman in his home.

The jury was shown CCTV footage of Musa returning to her car in the apartment car park after the confrontation.

A fully clothed Mr Thagipur could be seen following a few minutes later before the vehicle slammed into him.

Musa broke down in tears as the court was shown the footage.

The pair met online and had been seeing each other since late 2019 and Musa considered the 31-year-old her boyfriend by June 2020, the court was told on Tuesday.

The last time the couple met in person was June 21, 2020. After this, Musa sent a number of text messages to Mr Thagipur but received no response.

Musa had damaged her car and the garage roller door after she tailgated another vehicle trying to gain entry to the complex.

Ms Blizard said Musa's actions amounted to murder because they were a deliberate attempt to either kill Mr Thagipur or cause serious injury.

She told the jury they should consider finding Musa guilty of manslaughter if they were not convinced.

Defence counsel Madeleine Avenell SC did not dispute her client drove at Mr Thagipur, but rejected allegations Musa used her car with murderous intent or in an unlawful manner amounting to manslaughter.

The jury will be taken to view the apartment complex on Thursday.
