On 6 May 2020, the Full Court of Federal Court gave its verdict on the ACCC’s appeal related to proceedings to prevent Pacific National’s possession of the Acacia Ridge Terminal in Brisbane by Aurizon.
As per ACCC, the acquisition would reduce the competition because of an undertaking that was provided to the Federal Court by Pacific National.
In this case, the Court could not find enough evidence that proves that the acquisition would result in lessening the competition. Thus, dismissed ACCC’s appeal.
