BHP Group Ltd (ASX:BHP) has been acquitted by Brazil’s Regional Federal Court of the 6th Region in the widely publicized Samarco dam collapse case, marking a significant legal victory for the company. This court decision cleared ASX mining stock BHP, along with joint venture Samarco and partner Vale, of criminal and environmental charges linked to the 2015 Fundão dam collapse, a disaster that tragically resulted in both loss of life and environmental damage.
The court’s ruling emphasized that reports, documents, and witness testimonies did not identify any specific individual actions by executives or technicians that directly caused the dam to collapse. The incident, one of the worst environmental disasters in Brazilian history, led to heightened scrutiny of both BHP and Vale, as well as numerous legal challenges in Brazil and abroad.
In response, BHP expressed its intent to review the judgment once it receives the formal decision. While this acquittal resolves significant criminal charges within Brazil, it does not affect related proceedings outside the country, such as the ongoing class action in the United Kingdom.
Ongoing UK Class Action
A substantial class action against BHP is currently progressing in the UK, representing over 600,000 claimants who are pursuing up to £36 billion ($70 billion) in compensation. This legal action alleges damages from the dam collapse and presents a significant financial risk for BHP despite the Brazilian court's ruling.
Notably, law firm Pogust Goodhead, which represents the UK claimants, criticized the Brazilian settlement, calling it inadequate and stating that victims had not been consulted in the settlement process. This class action highlights the contrasting legal landscapes and outcomes BHP faces in multiple jurisdictions as it seeks to address its accountability in the incident.
Commitment to Community Support in Brazil
In Brazil, BHP has reiterated its commitment to supporting the communities impacted by the dam collapse. Recently, BHP and Vale finalized a significant settlement with the Brazilian government, which includes $45 billion in compensation and prohibits claimants accepting compensation in Brazil from participating in the UK class action. This agreement was reached after extensive negotiations and aims to deliver both direct and indirect benefits to approximately 500,000 people in Brazil.
The settlement includes substantial economic and environmental recovery efforts, such as health system funding, income support for affected individuals, and dedicated support for impacted farmers, fishers, and Indigenous communities. Additionally, 100 billion reais will be distributed over 20 years for public projects, with another 32 billion reais directed toward environmental remediation.
BHP’s efforts continue to focus on long-term recovery and support for those affected by the Samarco disaster, aiming to foster resilience and restoration across the impacted Brazilian regions.
