The ACCC has applied for a special leave to appeal Pacific National merger decision.
As per Rod Sims, the Chairperson of ACCC, the Full Federal Court’s verdict does not realise the overall effect of the proposed acquisition on competition in this vitally important industry. He also stated that competition depends on rivals having the chance to compete. With this acquisition, the entry would become effectively unbeatable and Pacific National’s near monopoly as the leading rail freight carrier on the east coast would be well-established.
