Watchdog Group Sues SEC Over Unreleased Crypto Conflicts Report

Empower Oversight has taken legal action against the U.S. Securities and Exchange Commission (SEC) over the delayed release of an internal report examining ethical concerns and enforcement practices related to cryptocurrency regulations. The SEC Office of Inspector General (SEC OIG) completed the report over a year ago, yet the agency has not made it public despite repeated requests under the Freedom of Information Act (FOIA). 

Lawsuit Seeks Disclosure of SEC Report 

The legal filing calls on the SEC to provide access to the finalized report, which focuses on conflicts involving William Hinman, the former Director of the SEC’s Division of Corporate Finance. Concerns have been raised regarding Hinman’s past ties to Simpson Thacher, a law firm with an interest in promoting Ether (ETH). The report is expected to provide insight into whether these affiliations influenced regulatory decisions on cryptocurrencies. 

Empower Oversight Pushes for Transparency 

Empower Oversight has been actively pursuing access to SEC documents since initially requesting communications between agency officials and cryptocurrency-related entities. Over time, the organization has initiated multiple legal efforts to obtain information, particularly regarding Hinman’s 2018 speech, where Ether was not classified as a security while similar digital assets faced different regulatory treatment. 

Concerns Over SEC’s Delayed Response 

The continued delay in releasing the report has led to increasing scrutiny of the SEC’s handling of cryptocurrency-related regulatory matters. Tristan Leavitt, president of Empower Oversight, has emphasized the importance of transparency, questioning the reasons behind the agency’s reluctance to disclose findings that could impact ongoing discussions about regulatory fairness in the crypto sector.
