BHP Wins Legal Victory in Brazil but Faces Ongoing Global Challenges Over Samarco Disaster

BHP Group Ltd (LSE:BHP, ASX:BHP), along with its joint venture Samarco and partner Vale, has secured a major legal win as the Brazilian Regional Federal Court of the 6th Region acquitted the companies of criminal and environmental charges stemming from the catastrophic Samarco dam collapse in 2015. This ruling marks a significant milestone in the protracted legal proceedings following the tragedy, which resulted in severe environmental damage and loss of life. 

Brazilian Court Acquits BHP and Partners 

The court’s decision comes after a thorough review of evidence, including documents, reports, and witness testimonies. The judges concluded that there was no specific individual action directly linked to the dam’s failure, thereby clearing BHP, Vale, Samarco, and 22 former executives of any criminal wrongdoing. 

In its statement, the court said: “The documents, reports, and witness testimonies examined did not identify specific individual actions that directly and decisively contributed to the dam’s collapse.” 

BHP welcomed the decision, but indicated it would review the ruling once the official judgment is received before determining its next steps. 

Ongoing Legal Battles in the UK 

While the Brazilian acquittal resolves significant legal challenges in that jurisdiction, it does not address the separate and ongoing $70 billion class action lawsuit against BHP in the UK. This case, involving over 600,000 claimants, alleges mismanagement and negligence by BHP in the lead-up to the dam collapse. 

Law firm Pogust Goodhead, representing the UK claimants, criticized the Brazilian settlement, describing it as inadequate and pointing out that victims had not been consulted in the process. The firm continues to push for compensation through the UK courts, seeking accountability and redress for those affected. 

The parallel UK lawsuit is seen as a major financial risk for BHP, with potential damages estimated to reach up to £36 billion ($70 billion). This legal action underscores the broader global repercussions of the disaster, extending beyond Brazil’s borders. 

Settlement Agreement with Brazilian Authorities 

In a separate development, BHP and Vale recently agreed to a substantial compensation scheme with the Brazilian government, aimed at providing long-term support and recovery for the affected communities. The agreement, valued at approximately $45 billion, includes provisions for economic and environmental recovery, health funding, and direct income support for impacted individuals, including farmers, fishers, and Indigenous groups. 

The settlement allocates 100 billion reais to public authorities over a 20-year period, with an additional 32 billion reais earmarked for remediation projects. Impacted individuals and small businesses are set to receive compensation of 30,000 reais per person. 

This comprehensive package aims to address the long-term effects of the disaster, while also limiting BHP’s liability exposure in other legal jurisdictions. The agreement stipulates that claimants who accept compensation in Brazil will be barred from joining the UK class action lawsuit. 

BHP’s Continued Commitment to Recovery Efforts 

BHP’s chief executive, Mike Henry, reaffirmed the company’s dedication to supporting the communities affected by the Samarco disaster. In a statement following the settlement, Henry emphasized BHP’s ongoing efforts to aid in the economic and environmental recovery of the region. 

“The settlement reached with the Brazilian authorities aims to provide both direct and indirect benefits to around 500,000 individuals,” Henry said. “Our focus remains on delivering meaningful support and sustainable recovery for those impacted by this tragic event.” 

The settlement covers a range of initiatives, from infrastructure restoration to health services funding, reflecting a comprehensive approach to addressing the aftermath of the disaster. However, the ongoing legal challenges in the UK and other jurisdictions continue to pose a significant overhang for the company. 

Looking Ahead: Legal and Financial Implications 

The Brazilian court’s acquittal represents a positive legal outcome for BHP, Samarco, and Vale, potentially mitigating some of the financial pressures related to the Samarco disaster. However, the unresolved UK class action lawsuit and potential claims in other jurisdictions remain critical issues for the company. 

BHP’s legal team now faces the task of navigating these complex, multi-jurisdictional challenges while maintaining its commitment to recovery efforts and stakeholder engagement. Investors and stakeholders will be closely monitoring the developments in the UK class action and any subsequent rulings, as these outcomes could have substantial financial implications for the company.
