Oxford Nanopore files for US subpoena

Oxford Nanopore Technologies (LSE:ONT), a leading provider of nanopore sequencing products, has initiated legal proceedings by filing an application with the US District Court for the Northern District of California. This application seeks authorization to serve subpoenas in support of a forthcoming lawsuit that will be filed in the courts of England and Wales.

The application, submitted ex parte, aims to grant Oxford Nanopore permission to issue subpoenas to Complete Genomics, Innomics, MGI Americas, and other associated parties. The lawsuit is set to address several serious allegations, including breaches of contractual obligations, breaches of common law duties of confidence, and violations of the Trade Secrets Regulations 2018. Additionally, Oxford Nanopore is seeking a legal entitlement to a license for certain patents.

In a related statement, Oxford Nanopore also expressed concerns about BGI Tech Solutions, which has developed its own nanopore-based sequencing technology. The company has indicated that it does not believe BGI Tech Solutions' technology could be used in commercial products globally without infringing upon or misappropriating Oxford Nanopore’s substantial portfolio of proprietary rights.
