A man trying to sell flowers on a Victorian roadside during Mother's Day weekend fell on his face after he was twice shot in the back, a court has been told.
Abil Malovski is facing a committal hearing in the Melbourne Magistrates Court, accused of shooting his ex-wife's friend at Melton in Melbourne's outer-west on May 7 this year. He was charged with attempted murder over the alleged incident.
His ex-wife claims she saw the shooting from her car. On Monday she alleged Malovski slowly drove past the flower stand she and her friend were manning minutes before the attack.
Malovski turned his neck so much to see her she thought it would "snap" as he drove past, she said. She told her friend about the alleged drive-by but he wasn't concerned, she said, describing him as a calm person.
She alleged that, when Malovski returned, he got out of his car, and he and her friend started moving towards each other before Malovski shot him "instantly".
"I literally saw it," she told the court, saying she did so through her rearview mirror.
Defence barrister Christopher Pearson questioned the woman as to whether her friend threatened to kill Malovski and chased him into an area behind the flower stall - suggestions she both denied.
She recalled seeing her friend's upper body jolt back after he was shot and said she left after he fell on his face.
The alleged victim rejected the barrister's suggestion he ran over to Malovski and told him: "What are you doing here c***? I'm going to f***ing kill you."
He started running as Malovski started shooting and that's when he was shot in the back, the man said.
He admitted he had criminal convictions, but said that was behind him.
When asked if he and Malovski's ex-partner were in a relationship, the alleged victim said they were just friends. The woman said they had a sexual relationship at the time of the incident.
The alleged victim claimed Malovski had threatened his ex-partner as well as himself in messages prior to the attack.
